Spouse, Common Law Partner, Cojugal Partner Sponsorship

Sponsor your partner to Canada.

To apply for your partner to come to live in Canada, you must prove to Immigration, Refugee, Citizenship Canada (“IRCC”), among other things that your partner is:
1. your Spouse,
2. your Common-Law Partner or
3. your Conjugal Partner.
To be categorized as a Spouse you must be must be legally married to your partner. To be categorized as Common-Law you and your partner must be in a live-in relationship for at least one year. To be categorized as a Conjugal Partner, you and your partner must be in a marriage-like relationship, but due to extenuating circumstances you have not been able to get married or to live together as Common-Law.

Depending on which of the above categories you and your partner fit in, your Application path may be different due t the required documents.

Inside of Canada vs. Overseas Application

  • Inside of Canada: where the Applicant would be inside of Canada at the time of applying; or
  • Overseas: where the Applicant would be outside of Canada, usually in their country, at the time of applying.

Your obligations as a sponsor

When you agree to be a sponsor, you are required to sign an undertaking, promising to give financial support for the basic needs of your spouse or common law partner and their dependent children.

Basic needs are:

  • Food, clothing, shelter and other needs for everyday living,
  • Dental care, eye care and other health needs that are not covered under the public health services.​

The undertaking which you will sign is a binding promise of support. The undertaking will not be cancelled, even if you divorce the Applicant, separate or your relationship with the Applicant breaks down.​

There is no required duration of marriage required to apply under the Spousal Sponsorship Category.
